By accessing this website or engaging our services, you agree to the following Terms of Service.

1. Scope of Services

We provide professional branding, marketing, website, design, and consulting services tailored to client requirements.

Project scope, timelines, deliverables, and pricing are defined separately through proposals, quotations, statements of work, invoices, or Master Service Agreements (MSA).

Any services outside the agreed scope may require additional timelines and charges.

2. Client Responsibilities

Clients are responsible for:

• Providing accurate business information and requirements

• Sharing approvals and feedback on time

• Providing access to required platforms/accounts

• Ensuring ownership or licensing of submitted assets/content

• Reviewing deliverables before final approval

Project delays caused by lack of communication, approvals, or incomplete information may affect delivery timelines.

3. Payments & Billing

All invoices must be paid according to the agreed payment schedule.

Typical payment structures may include:

• Advance payments before project initiation

• Milestone-based payments

• Monthly retainers for recurring services

• Advertising budgets billed separately from agency fees

Unless otherwise specified:

• Payments made are non-refundable once work has commenced

• Late payments may result in paused services or delayed delivery

• Third-party platform costs (hosting, domains, plugins, advertising spend, software subscriptions, stock assets, etc.) are billed separately unless explicitly included

Accepted transaction currency: INR (Indian Rupees)

For international clients, payments may also be accepted in USD or other supported currencies.

4. Intellectual Property

All original deliverables created by Pit Crew Agency remain the property of the agency until full payment is received.

Upon complete payment:

• Final approved deliverables are transferred to the client for agreed usage

• Working files, source files, drafts, or unreleased concepts may remain agency property unless explicitly included

The agency reserves the right to showcase completed work in portfolios, social media, presentations, or marketing materials unless restricted by NDA.

5. Revisions & Approvals

Reasonable revisions are included based on the agreed scope.

Excessive revisions, change requests, or major scope modifications may incur additional charges.

Once a deliverable is approved, any further changes may be treated as a separate request.

6. Third-Party Platforms & Services

Projects may involve third-party platforms such as Framer, Shopify, Meta, Google, Zoho, Figma, hosting providers, CRMs, or other external services.

We are not responsible for:

• Downtime or issues caused by third-party platforms

• Policy changes made by external platforms

• Suspensions, bans, or restrictions imposed by external services

• Third-party subscription or renewal fees

Clients are encouraged to maintain ownership of their business accounts whenever possible.

7. Marketing & Advertising Disclaimer

While we strive to improve visibility, performance, and business growth, specific business outcomes or revenue figures cannot be guaranteed.

Advertising performance may vary depending on:

• Industry competition

• Market conditions

• Product-market fit

• Budget allocation

• Seasonality

• Platform algorithm changes

• Client responsiveness and operational capacity

8. Confidentiality

Any confidential business information shared during the project will be treated responsibly and will not be disclosed to unauthorised third parties except where required for project execution.

Separate Non-Disclosure Agreements (NDAs) may be executed where applicable.

9. Limitation of Liability

Pit Crew Agency shall not be liable for:

• Indirect or consequential damages

• Business losses or loss of profits

• Platform account restrictions

• Data loss caused by third-party systems

• Delays arising from external dependencies

Maximum liability shall not exceed the amount paid for the specific service involved.

10. Termination

Either party may terminate an ongoing engagement through written notice.

Any completed work and pending payments up to the termination date remain payable.

Recurring retainers or subscriptions may require prior notice based on the agreement terms.

11. Governing Law

These terms shall be governed by the laws of India.

Any disputes shall fall under the jurisdiction of courts located in Visakhapatnam, Andhra Pradesh.
